Assault comes in 4 degrees.
RCW 9A.36.041 – Assault 4th Degree: This is common among domestic violence charges. They are simple misdemeanor charges. If you are charged with an Assault 4th Degree – “DV”, this means it is a domestic violence type of case. It is often not easy, sometimes impossible to erase that ‘DV’ designation.
RCW 9A.36.031 – Assault 3rd Degree: This is a more serious criminal charge. It is a felony and in lawyer speech it is considered ‘felony-land’.
